Pennsylvania Commonwealth Court rules in favour of Sunoco鈥檚 Mariner East 2 Project

Sunoco Logistics Partners has recently issued a statement regarding the Pennsylvania Commonwealth Court鈥檚 decision to rule in favour of Sunoco Pipeline鈥檚 Mariner East 2 project.
鈥楾oday, the Pennsylvania Commonwealth Court decisively affirmed a lower court decision that Sunoco Pipeline L.P. (Sunoco Pipeline) is a public utility corporation, as determined by the Pennsylvania Public Utility Commission, and that the company鈥檚 Mariner East 2 project provides a public service to Pennsylvanians.
鈥楾he court further ruled that Sunoco Pipeline has the right to exercise the power of eminent domain, as authorised by Pennsylvania law. The court's decision reaffirms every decision by lower courts across Pennsylvania as to Sunoco Pipeline鈥檚 status as a public utility corporation. The issue has been previously decided by lower courts stretching from south-west through south central to south-east Pennsylvania.
鈥楢lthough this case confirmed Sunoco Pipeline's public utility status, we have always worked with landowners to reach mutually acceptable agreements, and pursued legal proceedings only in those instances where an agreement could not be reached. We believe negotiation is better than litigation, and that landowners receive more favourable terms and compensation as a result of easements that are negotiated rather than litigated.鈥�
